DNVPS' liability for any loss or damage whatsoever and howsoever caused by its bodies, officers or employees or caused by others who are instrumental in carrying out DNVPS' contractual obligations to the Client, whether or not such person has acted negligently or otherwise and whether or not the loss or damage has affected the Client or any third party who without having any contractual relations with DNVPS has acted or made arrangements in reliance on decisions made or information given by or on behalf of DNVPS, shall be limited to USD200,000 (Two Hundred Thousand) or an amount equal to ten times the agreed fee to be charged for the service in question, whichever is less.
